The following are true in Wisconsin dog bite claims:

  • Unless you did something to instigate the attack by harassing or mistreating the dog or trespassing on marked property, the dog owner is fully and personally responsible for financial damages.
  • In the case of small children under the age of 7, the dog owner is always responsible, even if the child was engaging in inappropriate behavior. What Does Wisconsin’s Dog Bite Law Say?

If a dog bites a person and breaks the skin, which is enough to cause permanent scarring or disfigurement, the owner of the animal will be held liable. The faulty party is responsible for two times the amount of the damages when he or she had reason to believe that this or her dog was previous, such as a history of biting another person. Details of this law can be found under Wis. Stat. § 174.02(1)(b).
